1. Introduction
These Terms of Service (“Terms”) govern your access to and use of Auctra, including our website, application, content generation tools, verification features, publishing workflows, subscriptions, and related services (collectively, the “Service”).
Auctra is operated by Keshiha Services Private Limited, located at 319, Rastrapati Bhawan, Plot 3, Sector 10, Dwarka, Delhi 110075, India (“Keshiha,” “Auctra,” “we,” “us,” or “our”).
By accessing or using the Service, you agree to these Terms. If you do not agree, you must not use the Service.
If you are using Auctra on behalf of a company, client, team, or other organization, you represent that you have authority to accept these Terms on their behalf.
2. What Auctra provides
Auctra is an AI powered content platform that helps users:
- Discover timely topic ideas and content angles.
- Generate articles, LinkedIn posts, X posts, X threads, and internal drafts.
- Apply Brand Profiles for personal brands, company brands, or client and executive brands.
- Review factual claims using available source backed evidence.
- View Trust Panel outputs for verified content.
- Generate featured images for eligible articles.
- Store, reuse, and manage generated content in a Content Library.
- Connect supported publishing destinations where available.
Auctra may add, modify, or remove features at any time.
3. Accounts and eligibility
You must provide accurate account information and keep it updated.
You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
You must not share your account access with unauthorized users or use another person’s account without permission.
You must be legally capable of entering into these Terms. If you are under the age required to consent to digital services in your jurisdiction, you may use Auctra only with appropriate parental or guardian consent.
4. Plans, subscriptions, credits, and billing
Auctra may offer Free, Creator, Pro, invite only team access, custom, or other plans.
Paid plans may include a fixed number of usage credits. Credits may be used for content actions such as drafts, verified posts, verified articles, images, variants, rechecks, or other features.
For annual subscriptions, payment is collected annually, but included usage credits may be allocated monthly unless stated otherwise at checkout. Unused credits may not roll over unless explicitly stated in your plan.
Auctra may change plan features, credit usage rules, pricing, or limits from time to time. If changes materially affect an active paid subscription, we will provide notice where required.
You agree to pay all applicable fees for your selected plan and any add ons you purchase.
Payments are processed through third party payment providers. We do not control all aspects of payment processing and may rely on those providers for transaction handling, settlement, refunds, chargebacks, and payment security.
5. Free plan and trials
Auctra may offer a Free plan, free trial, beta access, or promotional credits.
Free features may be limited by topic discoveries, draft generations, verified trials, Trust Panel access, storage, publishing, images, or other limits.
Auctra may modify, suspend, or discontinue free plans, trials, promotional access, or beta access at any time.
6. Cancellation and refunds
You may cancel your subscription according to the cancellation process available in your account or through our support process.
Unless stated otherwise at checkout or required by applicable law, cancellation stops future renewals but does not automatically entitle you to a refund for the current billing period.
Refunds are handled according to our Refund Policy.
7. AI generated content and verification
Auctra uses AI systems and third party providers to assist with research, drafting, rewriting, verification, image generation, and content workflows.
Auctra’s verified content features are designed to check factual claims such as numbers, dates, names, and specific assertions against available source backed evidence before the output is shown to you.
Claims that cannot be supported may be flagged, softened, rewritten, or removed.
However, AI systems and external sources can be incomplete, outdated, inconsistent, or incorrect. Auctra does not guarantee that every output will be complete, current, without errors, suitable for your purpose, or legally compliant.
Auctra may support multiple languages, but users remain responsible for reviewing language accuracy, tone, translation quality, and local context before publishing.
You are responsible for reviewing, approving, editing, and deciding whether to publish any content generated through Auctra.
You should obtain qualified professional advice before relying on content involving legal, financial, medical, tax, political, scientific, regulatory, safety, or other high stakes topics.
8. User content
“User Content” includes any content, prompts, topics, brand profiles, writing samples, article library entries, uploaded materials, generated drafts, outputs, images, comments, feedback, or other information you submit to or create through Auctra.
You retain ownership of your User Content, subject to the rights granted in these Terms.
You grant Auctra a limited, non exclusive, worldwide license to host, process, transmit, display, reproduce, and use your User Content only as needed to provide, maintain, secure, and improve the Service, comply with law, enforce these Terms, and support your account.
Auctra does not claim ownership of your generated content.
Auctra does not sell your User Content.
Auctra does not use customer content to train shared AI models unless you explicitly opt in, where such an option is provided.
9. Generated outputs
Subject to your compliance with these Terms and payment obligations, you may use generated outputs for personal, commercial, business, or publishing purposes.
You are responsible for ensuring that your use of generated outputs does not infringe third party rights, violate platform rules, mislead audiences, or breach applicable law.
Because AI systems may produce similar or identical outputs for different users, Auctra cannot guarantee that generated outputs are unique to you.
You should review generated outputs for originality, accuracy, tone, legality, and suitability before publishing.
10. Brand Profiles, article libraries, and connected accounts
Auctra may allow you to create Brand Profiles for yourself, your company, clients, or executives.
You are responsible for ensuring that all brand information, product details, service descriptions, credentials, claims, keywords, and article library entries are accurate and authorized for use.
If you connect third party accounts, including publishing or website platforms, you authorize Auctra to access and use those accounts only as needed to provide the requested integration features.
You are responsible for complying with all third party platform terms, policies, and permissions.
Auctra is not responsible for changes, outages, limitations, suspensions, API restrictions, or policy changes by third party platforms.
11. Acceptable use
You must use Auctra lawfully and responsibly.
You must not use Auctra to create, publish, promote, or distribute content that is illegal, harmful, abusive, deceptive, defamatory, infringing, discriminatory, sexually exploitative, violent, malicious, or otherwise prohibited by our Acceptable Use Policy.
You must not use Auctra to generate spam, impersonation content, misinformation, malware, phishing content, fraudulent offers, deceptive political persuasion, or content intended to manipulate, harass, exploit, or harm others.
12. Prohibited technical activity
You must not:
- Attempt to reverse engineer, scrape, copy, or extract Auctra’s prompts, workflows, source code, models, datasets, pricing logic, or security controls.
- Attempt to bypass rate limits, credit limits, feature gates, authentication, or payment controls.
- Use automated systems to overload or abuse the Service.
- Introduce malware, malicious prompts, prompt injection attempts, or harmful code.
- Attempt to access data belonging to other users.
- Interfere with Auctra’s systems, infrastructure, integrations, or providers.
- Use Auctra to test, develop, or benchmark competing services without written permission.
13. Intellectual property
Auctra, including its software, workflows, design, prompts, interfaces, brand, logo, website, product structure, and related materials, is owned by or licensed to Keshiha Services Private Limited.
These Terms do not grant you ownership of Auctra’s intellectual property.
You may not copy, modify, distribute, sell, lease, or create derivative works based on Auctra’s software, design, prompts, workflows, or proprietary materials except as permitted by law or written agreement.
14. Feedback
If you provide feedback, ideas, suggestions, or recommendations, you grant Auctra the right to use them without restriction or compensation, provided we do not disclose your confidential information in doing so.
15. Privacy and data protection
Your use of Auctra is also governed by our Privacy Policy, Cookie Policy, Data Retention Policy, and other applicable data policies.
16. Security
We use reasonable technical and organizational measures to protect the Service and user data. However, no system is completely secure.
You are responsible for using strong passwords, protecting your login credentials, and promptly notifying us of any suspected unauthorized account access.
17. Service availability and changes
Auctra may be unavailable from time to time due to maintenance, outages, provider issues, upgrades, security events, or circumstances beyond our control.
We may modify, suspend, or discontinue any part of the Service at any time.
We are not liable for loss resulting from Service downtime, integration failures, data delays, third party outages, or unavailable features.
18. Third party services
Auctra may use third party providers for AI processing, search, hosting, analytics, payments, email, storage, publishing integrations, and other functions.
Your use of third party services may be subject to their own terms and policies.
Auctra is not responsible for third party services, websites, APIs, platforms, or content.
19. Disclaimers
The Service is provided on an “as is” and “as available” basis.
To the maximum extent permitted by law, Auctra disclaims all warranties, whether express, implied, statutory, or otherwise, including warranties of accuracy, completeness, merchantability, fitness for a particular purpose, non infringement, availability, and operation without errors.
Auctra does not warrant that generated content will meet your expectations, achieve engagement, improve rankings, produce revenue, avoid platform moderation, or be suitable for any particular use.
20. Limitation of liability
To the maximum extent permitted by law, Auctra and Keshiha Services Private Limited will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, revenue, goodwill, data, business opportunity, reputation, or content.
To the maximum extent permitted by law, our total liability for any claim relating to the Service will not exceed the amount you paid to Auctra for the Service in the three months before the event giving rise to the claim, or INR 5,000, whichever is higher.
Some jurisdictions do not allow certain limitations, so some of these limitations may not apply to you.
21. Indemnity
You agree to indemnify and hold harmless Auctra, Keshiha Services Private Limited, its directors, officers, employees, contractors, affiliates, and providers from claims, losses, damages, liabilities, costs, and expenses arising from:
- Your use of the Service.
- Your User Content.
- Your generated outputs.
- Your publication or distribution of content.
- Your breach of these Terms.
- Your violation of law or third party rights.
- Your misuse of third party integrations or connected accounts.
22. Termination
We may suspend or terminate your access to Auctra if:
- You breach these Terms.
- You violate our Acceptable Use Policy.
- Payment fails or charges are disputed.
- Your use creates legal, security, operational, or reputational risk.
- We are required to do so by law or a provider.
- Upon termination, your access to the Service may stop immediately. We may delete or retain account data according to our Privacy Policy and Data Retention Policy.
23. Governing law and jurisdiction
These Terms are governed by the laws of India.
Subject to applicable law, courts located in Delhi, India will have jurisdiction over disputes arising from or relating to these Terms or the Service.
24. Changes to these Terms
We may update these Terms from time to time.
If changes are material, we will take reasonable steps to notify users, such as by posting an updated version on the website or through the Service.
Your continued use of Auctra after the updated Terms become effective means you accept the updated Terms.
